Terms of Use Policy Agreement
1. User Consent. By using Frozen Talents’ website and or any usage of Frozen Talent’s apps, you hereby give Frozen Talent your implied consent to the terms and conditions herein. This policy begins effect immediately upon such use. If, at any time you do not agree to all of the following terms and conditions then you should immediately notify Frozen Talents and discontinue all usage of its website and apps.
2. Description of Our Services. Frozen Talents is a solely owned and operated software development company. We develop software applications and sell these applications on the AppStore website market. Frozen Talents is not affiliated or a part of AppStore.
3. Prohibited Website Use. You agree to utilize our website solely for its intended purpose only and in accordance to our Terms of Use Policy. In no event shall you use our website for any illegal or unlawful purpose of any kind.
4. Disclaimer of warranties of Website Use. The information provided to you on our website and/or on the AppStore website is on an "As Is" basis, without any warranty or representation of any kind. We disclaim all warranties express, implied or statutory including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, non-infringement of 3rd parties and implied warranty from course of dealings or course of performance to the fullest extent allowed by applicable law or statute. In addition we do not provide any warranties and/or representations to the following; our website and/or AppStore’s website will be available any particular time or location or that its operation will be uninterrupted or error free, the validity, accuracy, currency, reliability and/or completeness of our website and/or AppStore’s website, or the content of our website and/or AppStore’s website is free of viruses, worms, adware or malware.
5. Limitation of liability and damages. In no event shall we be held liable or responsible for any direct, indirect, general, special, exemplary, incidental or consequential damages or loss of any kind, arising out any breach of contract, negligence, tort, or strict liability in connection with or arising out of the use of our website and/or AppStore’s website or your reliance on any information provided on our website or AppStore’s website thereof.
6. Indemnification. You agree to defend, indemnify, and hold harmless, Frozen Talents, its employees, contractors, affiliates, agents, representative and any 3rd parties working for our behalf, from and against any claims, demands, losses, damages, fines, penalties or other expenses, including court cost and attorneys’ fees) resulting from any breach of contract, or any violation of any law or statute.
7. Intellectual Property:
A. Website Copyright and Trademark. All text and image information contained on Frozen Talents site are owned by Frozen Talents. Frozen Talents reserve all rights to copyright and trademark all texts, logos, images, illustrations and all other material published on our website and/or AppStore’s website, with the exception of 3rd party licensed material. All such material contained on Frozen Talents’ website and/or AppStore’s website are for personal use only and may not be copied, reproduced, modified, published, uploaded, downloaded, posted, transmitted or distributed in any way, with the effective prior written consent of Frozen Talents.
B. App. Software License. All software programs, source codes, technical data, etc, contained in the apps developed by Frozen Talents are owned by Frozen Talents. Frozen Talents grants it customers who purchase Frozen Talents apps a nonexclusive and nontransferable license to use the app. Customer agrees that Frozen Talents licensed materials, including specific design and structure of the app, constitutes trade secrets and/or copyrighted material of Frozen Talents. Customer agree not to disclose, convey or otherwise make available such trade secrets or copyrighted material to 3rd parties in any form without the prior effective written consent of Frozen Talents. Customer agrees to ensure and maintain reasonable security measure to protect such material owned by Frozen Talents.
8. No Waiver.The waiver or failure of us to exercise in any respect any right provided in our Terms of Use Policy shall not be deemed or constitute a waiver of any other right or remedy to which we may be entitled.
9. Governing Law and Jurisdiction:
A. Website Use: Access to Frozen Talents website is subject to all applicable federal, state and local laws and regulations. Unauthorized use of this Frozen Talents’ website is prohibited and violators will be prosecuted. By using our website, you consent to the jurisdiction of the state and federal courts of Doha, Qatarfor any action or proceeding arising under or relating to these Terms of Use, this Site or the use of, or reliance on, this Site. Frozen Talents’ Terms of Use policy is made under and shall be construed according to the laws of Doha, Qatar. In the event of a breach of contract under this Terms of Use Agreement, any and all disputes must be settled in a court of competent jurisdiction in the Doha, Qatar. This Website is directed at and made available only to persons who reside in countries where Frozen Talents Products or services are advertised.
B. App Use: All software, including technical data, is subject to U.S. export control laws, including the U.S. Export Administration Act and its associated regulations, and may be subject to export or import regulations in other countries. Customer agrees to comply strictly with all such regulations and acknowledges that it has the responsibility to obtain licenses to export, re-export, or import Software.
10. Unenforceable Provisions. If any of the provisions of Frozen Talents’ Terms of Use Policy are found to be unenforceable, the remainder shall be enforced as fully as possible and the unenforceable provision(s) shall be deemed modified to the limited extent required to permit enforcement of our Terms of Use Policy as a whole.
11. Other Jurisdictions. Our website and its contents, which are controlled and operated by us, located in Doha, Qatarand are intended to comply with the laws and regulations in Doha, Qatar. Website users accessing our website outside of Doha, Qatar, may have regulatory and statutory requirements that differ from those in the Doha, Qatar. Those who choose to access our website from nonDoha, Qatarlocations are responsible for compliance with their respective local laws. Any offer, promotion or and/or deal for any 3rd party product and/or service published on our website is void where prohibited.
